Terms of Use (EULA)

1. Acceptance of Terms

These Terms of Use and End User License Agreement ("Terms") govern your access to and use of the Fitness Challenge mobile application and website operated by FamilyUnion Technologies LLC ("we", "us", or "our"). By downloading, installing, registering an account, or using the App, you agree to comply with and be bound by these Terms. If you do not agree, do not download, install, or use the App.

2. License Grant & Scope of Use

Subject to your strict compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on mobile devices that you own or control:

• iOS Devices (Apple App Store): Your use must comply with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Android Devices (Google Play Store): Your use must comply with the Google Play Terms of Service.

3. In-App Purchases & Auto-Renewing Subscriptions

Fitness Challenge offers optional auto-renewable premium subscriptions ("Fitness Challenge Premium") that unlock unlimited challenges, advanced analytics, custom challenge rules, and AI opponents.

• Billing & Payment:
  • For purchases made through the Apple App Store, payment will be charged to your Apple ID account upon purchase confirmation.
  • For purchases made through the Google Play Store, payment will be charged to your Google Play account upon purchase confirmation.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly, annually, or as specified during purchase) unless cancelled at least 24 hours prior to the end of the current billing cycle.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-applicable renewal rate.
• Managing & Cancelling Subscriptions: You can manage or cancel your subscription at any time through the respective platform's account settings:
  • iOS: Go to Settings > [Your Apple ID] > Subscriptions on your Apple device.
  • Android: Open the Google Play Store > Profile icon > Payments & subscriptions > Subscriptions.
• Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
• Refunds: All refund requests must be directed to the respective store where the purchase occurred (Apple Support for iOS, Google Play Help for Android) and are governed by their respective refund policies.

4. Platform-Specific Terms (Apple & Google)

You acknowledge and agree that these Terms are entered into between you and FamilyUnion Technologies LLC only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Neither Apple nor Google is responsible for the App or its content.

• Apple Minimum Terms (App Store):
  • Maintenance & Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
  • Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
  • Product Claims: FamilyUnion Technologies LLC, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including product liability claims, consumer protection claims, and regulatory compliance.
  • Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, FamilyUnion Technologies LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• Google Play Terms (Android):
  • Your use of the App via Android is subject to the Google Play Terms of Service. Google is not responsible for the performance, maintenance, support, or warranty of the App.
  • Google and its affiliates are third-party beneficiaries of these Terms with respect to your use of the Android version of the App.

5. User Accounts & Data

To use certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials. You agree that all fitness step data and profile information you provide is accurate and truthful.

6. Acceptable Use & Code of Conduct

You agree not to engage in any of the following prohibited activities:

• Manipulating or falsifying step count data or fitness metrics.
• Harassing, abusing, or harming other users in group challenges or chats.
• Attempting to reverse engineer, decompile, or disassemble any portion of the App.
• Using automated scripts, bots, or cheats to alter leaderboard rankings.

7. Health Disclaimer

Fitness Challenge is designed for fitness tracking, peer accountability, and entertainment purposes only. The App does not provide medical advice. Consult a healthcare professional before starting any physical exercise program or changing your physical activity habits.

8. Disclaimer of Warranties & Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAMILYUNION TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

9. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users or our service.
